An American national, whose marriage to a Ugandan woman broke down more than a year ago, has sued his wife for breach of trust by framing him to sell his property.
Mr Paul Roger Mathias filed the suit in the High Court against Ms Lilian Kaitesi (former wife).
He asserts that he was lured to register his vehicle in his former wife’s name before they divorced as he waited for a certificate of residence from Uganda’s Ministry of Internal Affairs.
Mr Mathias says Ms Kaitesi has since divorced in the Family Division of the High Court in Makindye, Kampala.
“The defendant got registered on the logbook well knowing she was holding the car in trust for the plaintiff and she agreed to that during the clearing process of the vehicle with the plaintiff,” the suit reads in part.
Mr Mathias states that Ms Kaitesi possessed the vehicle until he was detained at Nalufenya Police Station in Jinja Municipality after she framed him with illegal possession of a firearm and he spent about a month in custody. He says he was later acquitted of all the charges.
Mr Mathias says while he was in detention, Ms Kaitesi started selling his property including the vehicle.
He is seeking court to declare that Ms Kaitesi breached the trust, that he is the rightful owner of the vehicle which should be returned to him and be awarded general and punitive damages.
