Goodlyfe singers Mowzey Radio and Weasel did not appear in court on Tuesday July 12th as they were earlier expected to, but were represented by their lawyer Mudde John Bosco, who informed court that his clients were not served with court summons and are currently in Kenya for the Coke Studio competitions. The duo were summoned to appear in court over libel and offensive communication charges against Team No Sleep boss, Jeff Kiwanuka about a week back but did not appear. This came after they uploaded a video on their Facebook page, accusing him of being a murderer, practicing witchcraft as well as being involved in child sacrifice.
“My lord, the accused persons were not physically served but they got informed on social media platforms yet service has to be personal. You can’t drop papers in somebody’s compound without any acknowledgement of receipt and you end up calling that service,” Mudde said before asking court to order the complainants to serve the two musicians with fresh summons.
In his reply, Kiwanuka’s lawyer Charles Nsubuga asked court to issue a warrant of arrest for the singers because they have got confirmation of service and that there is no evidence on record to prove that the two are in Coke Studios as alleged by their counsel.
“Court can’t be held at ransom by suspects. If the counsel got to know of this case via social media platforms, then his clients are also assumed to have got information about it in the same way,” Nsubuga said.
Immaculate Angutto, the state prosecutor asked Makindye Grade One Magistrate, Juliet Nakitende to allow the Director of Public Prosecutions (DPP) to take over the matter as mandated by the Constitution of the Republic of Uganda.
Tomorrow the grade one magistrate will be giving her ruling on the matter and on DPP’s request to take over prosecution.
